CHARLESTON, WV — West Virginia nursing home recently agreed to a settlement with the U.S. Department of Labor to resolve allegations that the company violated federal wage and labor laws by failing to pay workers overtime wages. The agreement with Stonerise Health LLC will compensate 498 healthcare employees from 16 facilities in West Virginia a total of $123,680 in back wages and liquidated damages. Locations covered by the agreement include company nursing homes in Morgantown, Kingwood, Clarksburg, Bridgeport, Parkersburg, Belmont, Berkeley Springs, Keyser, Martinsburg, Charleston, Princeton, Beckley, Rainelle, Lindside, Ronceverte, and Wellsburg.
According to an investigation by the Labor Department’s Wage and Hour Division, Stonerise Healthcare violated the overtime provisions of the Fair Labor Standards Act (FLSA) when it improperly calculated worker pay. Investigators determined that the company failed to take into account bonuses included those paid for initial sign-on, picking up extra shifts, and good attendance records, among other incentive payments regularly made available to and earned by workers.
Under the FLSA, employers must pay workers one and a half times a workers average hourly wage, including bonuses, when the individual works more than 40 hours per week. Often times, these types of violations occur because companies only take into account the worker’s hourly base pay and not any other compensation.
“We are committed to ensuring that employees receive the wages they have rightfully earned,” said Wage and Hour District Director John DuMont, in Pittsburgh, Pennsylvania. “We are also committed to ensuring that employers who fail to comply with the law do not gain an unfair competitive advantage over those who do.”
