RALEIGH — Filed in October 2015, a class action lawsuit named Boss Services Inc. as responsible for intentionally misclassifying employees to avoid employment benefits required under the Fair Labor Standards Act in addition to state and federal law.
These employment benefits the company attempted to avoid included taxes, unemployment insurance, and additional worker compensation obligations. In being label independent contractors instead of standard employees, plaintiffs were required to work off the clock as they stripped of their ability to claim overtime compensation.
The case has not yet gone to trial and is currently pending further action in the U.S. District Court for the Eastern District of North Carolina.

In defining their employees as independent contractors Boss Services Inc., was able to avoid paying their employees their just benefits.
