California Warehouse Workers Accuse Amazon of Violating Overtime Pay Laws

LOS ANGELES — A pair of former warehouse workers for online retail giant Amazon recently filed a proposed class action unpaid overtime lawsuit against the company over allegations that the two employees and others were not paid overtime and other wages required under California labor and wage laws. The lawsuit is one of many similar legal claims being levied against the retail and multimedia company, including other allegations the company went to great lengths to reduce payroll hours by engaging in a variety of unscrupulous business practices.

The unpaid overtime lawsuit, filed in Stanislaus County Superior Court, claims Amazon shorted two workers on regular and overtime pay when it forced employees to work through lunch breaks without an additional hour of regular hourly pay required under state law. State labor laws require all hourly workers be given an uninterrupted 30-minute meal and rest break immediately following the individual’s fifth hour on the job. Furthermore, the law requires employees be furnished an additional rest break after 10 hours on the job.

Additionally, California wage laws require employers pay workers an additional hour of regular hourly pay for working split shifts. Under the law, California considers a split shift to be a work schedule interrupted by a non paid, non working period established by the employer. California is unique in that it requires companies provide this type of additional pay to workers.

Finally, the lawsuit claims Amazon failed to pay workers one and a half time their regular hourly rate of pay for overtime hours. In California, workers can earn overtime pay both by working more than 40 hours in a week, just as all hourly non-exempt workers are across the country, and by working more than 8 hours in a day.

The lawsuit seeks class action status to allow potentially hundreds or even thousands of other workers at various facilities across the state to join together and recover unpaid wages. The lawsuit seeks back pay with interest, liquidated damages, attorneys fees, court costs and any other relief the courts may see fit to award the plaintiffs.
