LOS ANGELES, CA — An employee for a trendy Los Angeles juice bar recently filed a class action unpaid overtime lawsuit against the company over allegations the defendant failed to pay workers for all their time on the job and went to great lengths to conceal the illicit practice. The lawsuit accuses Kreation Organic Juicery of failing to pay one and a half times workers’ average hourly rate of pay, failure to provide uninterrupted meal and rest breaks under California wage and labor laws, and other violations of state and federal law.
According to the class action overtime pay lawsuit, filed in December 2016 in Los Angeles County Superior Court, Kreation Organic Juicery used multiple business locations to conceal the fact that employees were working well over 40 hours per week for the company. The plaintiff charges that the first 40 hours of wages on her paycheck would come from one entity, while any remaining overtime would come from another business entity linked to the defendant.
This type of practice is common among area chains looking to keep payroll down at the expense of hardworking employees. Under the law, no matter how many different business locations employees work for, workers must be paid one and a half times their average hourly rates of pay for overtime. Sometimes, employers move workers around from one location to another to try and conceal overtime wages, telling workers that the 40-hour overtime threshold only counts at one location.
The lawsuit also alleges the defendant failed to give workers their 30-minute uninterrupted meal break, as required under California labor and wage laws. Under the statute, if the employer cannot give a worker his or her meal break, the employee must be compensated with an additional hour on regular hourly pay. The complaint seeks to recover unpaid overtime, regular pay for missed meal breaks, interest, liquidated damages equal to back pay, court costs, and attorney’s fees to litigate the matter and recover worker wages.
