The case was filed in the U.S. District Court Western District of Kentucky. It alleges that Jack Rabbit Services intentionally misclassified its roadside assistance workers as independent contractors in order to avoid paying them overtime pay, therefore adopting and implementing employment policies that violate the Fair Labor Standards Act (FLSA).
In addition to the intentional misclassification, Jack Rabbit also willfully refused to pay a minimum wage and reduced employee wages through unlawful deductions.
The following services provided by these employees included tire changing, jump starts, fuel delivery, and lockout services. During the past three years, Jack Rabbit has provided roadside assistance services to customers in at least 50 markets in multiple states across the United States, including, but not limited to, locations in: Alabama, Arkansas, California, Florida, Indiana, Kansas, Kentucky, Louisiana, Maryland, Mississippi, North Carolina, New York, Ohio, South Carolina, Texas, Virginia and West Virginia.
