What are the Laws for Satellite Installer Overtime Pay?

Under the Fair Labor Standard Overtime Laws (FLSA), any employee that is classified as “covered” is eligible to receive overtime pay. Typically, satellite installers are classified as “covered” by the FLSA; therefore they are entitled to overtime wages.

Many companies will classify its satellite installers  as “independent contractors” or paid on a “piece rate” compensation system in order to avoid the federal and state overtime and minimum wage requirements. As a result, workers are cheated out of the wages they lawfully deserve under the FLSA laws.

Even if you are paid by “piece rate” or as an independent contractor, you still may be entitled to such wages. As a result, employers are required to pay time-and-a-half, and piece rates for all overtime hours worked.

However, classification can be quite confusing and complex as it is often determined not by the occupation but the job duties, job description, rate of pay, and number of hours worked by that specific employee and state laws. It is important that you consult an experienced overtime pay lawyer to help you determine if you are covered under the FLSA or not.

Is a Satellite Installer Entitled to Overtime Pay?

The duties of a satellite installer often require long work hours, and many times hours worked by satellite installers exceed 40 hours in one week. Any hours worked after 40 in a single work week is considered overtime, and under the FLSA, non-exempt employees are entitled to overtime pay of one and one-half times the regular rate of pay.

Typically, satellite installers, even those who are paid by “piece rate” or as independent contractors, are classified as “covered” by the FLSA and therefore entitled to overtime wages.

In calculating the number of overtime hours worked, all required work performed in all facilities and departments, both before and after a shift, including staff meetings and required paid training should be considered.  In addition, overtime hours can include travel time between jobs, time spent at the shop, time spent waiting between jobs, and work performed at home. If an employer does not include all of this time in the calculation of hours worked, it can result in the satellite installer not receiving all of the required overtime wages.  The employer’s failure to pay required overtime to its workers can result in a lawsuit for overtime pay.

Does a Company Have to Pay Overtime Wages to a Satellite Installer?

In most cases, satellite installers are covered under the FLSA, and therefore a company is required to pay overtime wages them overtime wages. Some companies may classify its satellite installers  as “independent contractors” or paid on a “piece rate” compensation system in order to avoid the federal and state overtime and minimum wage requirements. In many cases, however, these workers are actually entitled to overtime pay and the companies have cheated them out of the wages they lawfully deserve under the Fair Labor Standards Act (FLSA) laws.

Additionally, if an employer does not include all of the time spent on work-related duties in the calculation of hours worked, it can result in the satellite installer not receiving all of the required overtime wages.

The employer’s failure to pay required overtime to its workers can result in a lawsuit for overtime pay. If your employer is denying you overtime or has failed to pay you for overtime hours worked, you may be able to file a lawsuit to collect back all owed wages.
