WICHITA, KS — A group of aircraft workers for a Kansas startup aircraft completions and modifications company recently filed an unpaid overtime lawsuit against their employer claiming that the company wrongfully denied them all their pay in violation of federal labor and wage laws. A dozen plaintiffs allege that the defendant, Emerald Aerospace, owes them an estimated $73,000 in back pay, interest, and damages from the time spent with the company.
According to the unpaid overtime lawsuit, filed in U.S. District Court for the District of Kansas, owes each of the workers anywhere from $1,211 to $17,500 in unpaid overtime dating back to 2016 when the company began operations in Wichita, Kansas. The lawsuit states that the company initially leased 200,000 square feet of hangars for its operations but cut back its workforce to just over 20 individuals and is currently not doing business at the same location anymore.
The lawsuit alleges that the defendant violated the Fair Labor Standards Act (FLSA) when it failed to pay the plaintiffs one and a half times their average hourly rates of pay when working more than 40 hours in a week. The FLSA sets national standards on minimum wages, overtime pay, and payroll recordkeeping. When companies break the law and underpay workers, the FLSA gives wage theft victims the right hire an unpaid overtime lawyer to file lawsuits and recover lost wages.
The FLSA allows wage theft victims to recover up to three years of unpaid wages for intentional violations, interest on back pay, liquidated damages equal to back pay, and attorneys fees to cover the cost of litigation. In some cases, courts may even impose injunctions on defendants that require the businesses to put in place new procedures to ensure accurate payroll records are produced and workers receive all their hard-earned pay. Because statutes of limitations do apply to wage theft cases under the FLSA, workers are encouraged to contact an experienced overtime pay lawyer as soon as possible.
